he United States Department of Commerce published on July 24 the preliminary results of the first full sunset review of the countervailing duties on Moroccan phosphate fertilizers, and recommends renewing them for a further five years.

Its provisional finding: revoking the order, in force since April 2021, would likely lead to the continuation of countervailable subsidies, at a rate of 20.04% ad valorem for OCP as for all other exporters.
The recommendation lands four weeks after a gesture pointing the other way. On June 29 the President of the United States declared an emergency and authorized the temporary duty-free importation of Moroccan phosphate fertilizers.
Washington thus shows two faces on the same product, one political and provisional, the other technical and lasting. It will fall to the International Trade Commission to decide.
